Legal Issues in Selling, Teach, and Performing on Online Platforms

Legal Issues for Online Platforms_1.jpg

As the Arts Sector "pivots" to continue working during a global pandemic, arts performances, sales, classes and more are moving to online platforms. This raises lots of new legal issues around intellectual property, particularly copyright, and other areas of law. Join local lawyers from Triangle ArtWorks “Law + ArtWorks” Resource Group as they discuss legal issues you should be aware of and answer your questions.*

This program will look at issues such as:

Basics of Copyright. Some questions you might ask:

  • Who owns what I create?

  • What can I use and re-use on my social media or in my video?

Infringement and “Fair Use.” Some questions you might ask:

  • What is fair use?

  • If we aren’t making money, is that fair use?

  • What is in the public domain?

  • Someone is using my work! Isn’t that just stealing? When would that be fair use?

  • Is fair use just a copyright loophole?

  • What do teaching artists need to consider when using other artists’ work in their online programs? What rules govern use of third party work in an online classroom setting and does it differ if you are a “school teacher” or charging for your classes independently?

  • Does the content I post on YouTube stay “mine”?

  • Can I use another artists’ picture/song/article in my class or do I have to ask permission?

Virtual Platform Issues. Some questions you might ask:

  • Do the legal considerations change based on the platform I am using?

  • What is the DMCA and how does it work?

  • Influencer and Social Marketing. Some questions you might ask:

  • How does the FTC regulate my social media use?

  • What is sponsored content?

Bring your questions and your experiences, as the lawyers will lead an open discussion on the most recent state of the law, as well as how the law affects your work. The examples above are just examples. All questions are welcome. Join us to learn what to expect and how to prepare. This will be a great opportunity to have your legal questions discussed and learn from others' experiences.

*Please be aware that our speakers will not be able to provide direct legal advice on specific situations. All questions answered and information provided will be of a general nature and does not create an attorney-client relationship with attendees.
